On Jan. 13, 2025, the Board of Appeals voted to grant setback variances for a carport at 8067 Sherman Place after the applicant, Garrett Gause, told the board the structure had existed for years and was first noted by code enforcement in 2018.
Staff said the 18-by-50-foot carport was built without a permit and is visible on 2017 aerial imagery. The survey shows the carport sits about 18.5 feet from the front property line where 25 feet is required (a variance of about 6.5 feet) and roughly 9.3 feet from the left side where 15 feet is required (a variance of about 5.7 feet). Speaker 3 asked whether the board would grant the variances with standard conditions.
Applicant Garrett Gause told the board he has owned the property and that "the shed is there... it's been there on the nose, for I think, it's 2009," and that he only learned a permit was required when he pursued additional work. The applicant said there had been no prior public complaint and that he learned of the code issue through routine permitting.
After brief board discussion, a motion to grant the requested variances was made and seconded; the board adopted the motion by voice vote and the chair announced the motion passed. The board imposed standard conditions tied to staff review and inspection.
