The Water Quality Committee voted to forward the Division of Mitigation Services’ proposed readoptions and the accompanying regulatory impact analysis (RIA) for 15A NCAC 02R to the Environmental Management Commission for formal readoption review.
Kelly Williams of the Division of Mitigation Services told the committee that staff recommended only minor technical and administrative edits and that the RIA had been finalized and approved by OSBM, showing "little to no impact on the state or local governments and no substantial economic impact." Williams said staff requested approval to proceed to the EMC in September to meet the readoption timeline; the readoption deadline noted in the meeting record is August 1, 2027.
A committee member moved that the committee approve proceeding to the EMC with the proposed amendments and RIA; the motion was seconded and the chair called a roll-call vote. The committee recorded four votes in favor and one nonvoting/abstention; the chair declared the motion passed. The meeting record shows the outcome as approved to proceed to the EMC.
The committee’s action sends the proposed rule readoptions and the RIA into the EMC process; any subsequent public-notice or comment steps will proceed under the EMC’s schedule.
