Commissioners continue Maitland Vista subdivision, seek city response on road jurisdiction

The board opened a public hearing on a vacation and associated plats that include the Maitland Vista subdivision and a sewer-line permit for Maple Road submitted by Excel Construction LLC. Staff presented a two-step plat process in which an existing publicly dedicated right-of-way would be vacated and a private easement later reestablished as a public easement.

Multiple members of the public and the developer raised concerns about road naming and jurisdiction, particularly whether a segment called Centennial Road would create confusion because parts of Centennial are on the county system while the city has planned extensions in its master plan. Property owner Rory Maynard and other commenters said the city intended to take over the road under its transportation plan; commissioners asked for clarification from Spearfish, requested responses from city engineers, and discussed possible section-line alignment and intersection control at McDermott and Maitland.

Given incomplete information and the absence of city representatives, the board voted to continue the item to the July 30 meeting so staff could get detailed answers on jurisdiction, easements and whether the county should relinquish authority for the road under statute 31-17-17. Commissioners noted potential safety concerns at the proposed intersection location and asked staff to provide options for intersection control if the plat proceeds.
