Council ties on Law Excavating change order; item tabled for committee review
Summary
MSA engineer Jared Fluhr presented a final payout request from Law Excavating of $24,368.59. A motion to deny the change order resulted in a 3–3 tie and failed; the council then voted 6–0 to table the matter and hold a committee meeting Feb. 18, 2025 at 1:00 p.m. at the Waste Water Treatment Plant for further review.
MSA representative Jared Fluhr told the council he and contractor Reid Law finalized changes and that the presented amount represented the final payout for work completed: $24,368.59.
Several council members said protocol for pre-approval of change orders was not followed. A motion to deny the request produced a 3–3 tie; the clerk asked Mayor Carl Bates to cast a tie-breaking vote and the Mayor voted no, so the denial motion failed. Alderman Jeff Soenksen then moved to table the item and schedule a committee meeting; that motion passed 6–0. The council set a committee meeting for Tuesday, Feb. 18, 2025 at 1:00 p.m. at the Waste Water Treatment Plant to review the changes further.
