The Kane County Commission voted unanimously on July 14 to adopt Ordinance 2026‑20, amending zoning of a 10‑acre parcel from Ag FAA to Agricultural to allow the property owner to pursue a yurt rental on the site.
County planning staff explained the Ag FAA zoning is more restrictive and the requested change would allow uses permitted in the Agricultural zone, which could include up to seven rental units if later approved by a Conditional Use Permit (CUP). Commissioner discussion focused on the potential for a future owner to change use intensity, the requirement that a 20‑foot road be provided for emergency access, and energy‑code implications if a yurt becomes a permanent dwelling.
"He just said rent it out," a commissioner observed about the owner's stated intent to rent a single yurt; staff noted the owner will still need to obtain a CUP and meet mitigation conditions. Another commissioner said the semi‑permanence of a yurt is preferable to a stick‑built structure because the land could more easily return to agricultural use. The motion to adopt the ordinance referenced findings in the staff report and passed with all commissioners voting aye.
