Montgomery DRB approves short-term rental at 13 Brook Street with limits and safety conditions

The Montgomery Development Review Board approved a conditional-use permit on Jan. 22, 2026, to convert a single-family dwelling at 13 Brook Street into a lodging establishment for short-term rental. The 4–0 vote followed a public hearing and deliberations and applies to Parcel ID #00037.002X in the Village 1 Zoning District.
Applicant Nathan Eller told the board he recently purchased the 0.17-acre property and intends to use it as a part-time secondary home and rent it when his family is not using it. He said the house has "3 bedrooms and a loft and can sleep 8 people" and described a detached two-car garage plus additional parking around the garage. When asked about parking by board member John Kuryloski, Mr. Eller said "there was enough room and if more room was needed renters could park in the garage." The board clarified that a loft is not considered a bedroom.
The board combined the Conditional Use review with a Hazard Area Review because the parcel lies within the river corridor. Evidence submitted to the board included the DRB application and building/zoning permit (Dec. 9, 2025), the Town property record card, a Vermont Meals and Rooms Tax license copy, a sketch of buildings and photos of the garage/parking area.
Board members approved the application with multiple conditions. Key conditions include: proof from the insurance company that short-term rental and renter liability coverage are included; a maximum of six renters (including children); at least four parking spaces; no overnight camping; quiet hours from 10 p.m. to 6 a.m.; posted house rules and a visible 911 location; registration with the State of Vermont for rooms and meals tax unless an online platform collects taxes; at least one fire extinguisher, a smoke detector and a CO detector on each level and a smoke/CO detector in each bedroom; and a contact person available within a 25-mile radius while the property is rented, with contact information visibly posted.
The board noted that the structures at 13 Brook Street are pre-existing in the river corridor and decided the conditional use permit does not alter that status. The hearing record shows the Zoning Administrator submitted public-notice documentation, and the minutes were signed by Chair Parma Jewett as Acting Clerk.
