Jazz Banes Wright, director of community partnerships and initiatives, provided updates about charter operators including Elite and its recent activities and assessment timelines.
Board members also discussed findings from a California Department of Education (CDE) review. Staff summarized that Elite had two findings related to attendance-reporting and that Elite submitted corrections and a revised appeal form; staff said CDE acknowledged a typographical error and, once CDE confirms the corrected appeal is formatted properly, CDE will proceed with review. Staff characterized the likely remedy as a potential nonmonetary resolution related to apportionment (for example, waiving the withholding of funds rather than requiring immediate repayment) if CDE accepts Elite's explanation.
A trustee asked what a "nonmonetary resolution" would look like; staff explained it typically means CDE might waive repayment or withholdment of future apportionment rather than demanding a cash repayment, depending on the circumstances of reporting discrepancies. Staff emphasized the back-and-forth nature of appeals and that the matter could be reviewed further once CDE acknowledges the corrected submission.
The board did not take formal action on Elite at this meeting but requested continued monitoring and updates on the audit and appeal status.
