Councilman Steve Ahlborn moved to go into executive session under Idaho Code 74-206(1)(b) to consider employee evaluation or disciplinary matters; Rob Hartsock seconded. The roll call vote was Ahlborn yes, Hartsock yes, Lupita Connor no and Blaide Connor no, producing a tie. Mayor David Porterfield stated he had conferred with counsel (Todd Lakey) and that a supermajority was not reached; the motion to enter executive session failed.
Later, agenda item 9.1 — a decision on a council member creating a service invoice with the city attorney regarding a June 1 "request for corrective action" letter — was not discussed because the mayor said it was directly related to the failed executive session. Councilwoman Lupita Connor insisted the item be discussed in open session and made a public statement of complaint; the mayor cautioned her about topics legally required to be discussed in executive session. No formal action on item 9.1 occurred.
