ZEO reports active cases, inspections and new complaints including vibration concerns at 0 Route 6

Zoning Enforcement Officer Savannah Kitchin reviewed the second-quarter enforcement report, listing active, resolved, and monitored cases across town. Notable items included contractor materials and excess trailers visible at 12 Lakeview Park (tenants contacted; re-inspection scheduled for August), a blight and unregistered-vehicle case at 10 Newberry Road (front of property now in compliance; full inspection pending), and a roaming-chickens complaint at 39 Whitney Road that showed no violations after multiple site visits.

Kitchin reported a resolved complaint about gunshot noise/time-of-day at 68 Brick/66 East (Maine Moose property) and said the owner of 121 Route 6 was unaware a permit review was needed for a parking expansion and is now in compliance. On 7 Lakewood she confirmed a drainage/flooding concern was not a zoning issue after consulting the town attorney. The commission discussed an active special-permit site at 0 Route 6 where earthwork and fill compaction prompted multiple complaints, including allegations of vibration impacts. Commissioners agreed they could not impose retroactive conditions but could assess whether current activity violates approval standards; R. Nassiff suggested the ZEO perform an on-site observation during active compaction, and S. Kitchin said she will do so and report back to the Commission. No enforcement action was taken pending factual assessment.

Commission members also signaled a possible future regulatory review of Section 65.3.22 to clarify whether compaction-related vibrations fall under a construction exemption and whether enforcement thresholds are necessary.
