Courtney DeGrove, the boards legal counsel, explained that anonymous letters are public records and were included in the packet, but she cautioned trustees that unverified allegations should not form the sole basis of a public appointment. Trustees reiterated that the ad hoc committee and the public interview process provided the primary factual bases for their decision. Several public commenters also expressed concern about the timing of an appointment one year prior to the next election, saying an appointment creates an incumbency advantage; trustees acknowledged the concern but pointed to the transparent process chosen by the board as the rationale for proceeding.
