Staff described the procedural steps: obtain a litigation guarantee from Montana Abstract, send required notices to heirs at the last known address, and if unpaid proceed to take tax deed to place the parcel in county ownership.
The presenter summarized the follow-up plan: "So this whole scenario is we will be looking at taking a tax deed for the county so that the county will then possess the property." After the county acquires the property, staff will offer it to the tribe for repurchase. Staff said tribal repurchase is common in the office's experience and the initial cost to the county is limited to the title/litigation-guarantee fee (about $170). Commissioners asked questions about mineral rights, possible liens and whether costs will be recouped; staff said the abstract will report on outstanding liens and market-value repurchase would likely recoup costs.
