The Bay Village Board of Zoning Appeals on April 16 approved variances allowing two air‑conditioning condensers at 588 Humiston to remain or be installed closer to the property line than the city code normally permits.
Mark Chernisky, representing property owner David Weix, told the board the new mini‑split condenser for a second‑floor addition would sit about 8 feet from the property line and therefore requires a 2‑foot variance under CO 1359.01. He said the existing condenser was placed without a variance and sits about 4 feet from the line; if it is replaced later it would need a 6‑foot variance to be brought into compliance. "We had nothing to do with the existing air conditioner nor did the current homeowner," Chernisky said, adding the applicants are not seeking to relocate that unit now.
Board members discussed site constraints and precedent. Chairman Clete Miller confirmed the electrical service is on that side of the building, and Scott Bruno said the existing unit has been effectively grandfathered. The board required that both condensers be screened from the neighboring property and the street with year‑round decorative fencing or vegetation. The motion to grant the variances — a 2‑foot variance for the new condenser and a 6‑foot variance applicable to the existing unit if and when it is replaced — passed 6‑0 (Bruno, Gess, Miller, Young, Rhea, Crawford).
The approval is limited to the condenser placements described in the application and the screening condition ordered by the board.
