The Louisville Board of Appeals on Nov. 18 unanimously approved an area variance permitting Charles and Tracy Bird to construct a modular home at 114 River Drive (tax map #8.047-1-34) with reduced front and side setbacks.
Code Clerk Terri O'Keefe told the Board the applicants requested a front setback of 53 feet, 5 1/4 inches from the road and a 4-foot side-yard setback that includes the proposed overhang. The parcel is zoned RR — Resort Residential, which the Board noted requires a 75-foot front yard setback and a 15-foot side-yard setback (35-foot total). Acting Chairman Carl Bender asked who would be responsible for tree maintenance if vegetation on the adjacent property interfered with the structure; Board members said the 4-foot side abuts vacant land owned by NYPA and the other side would sit about 20 feet from a neighbor's home.
"Jeff moved to approve the area variance request for the front and side yard setbacks for the new home build," Jeff Laba said before the motion was seconded by Scott Lashomb. "All in favor," the Board recorded, and the request was approved unanimously. The clerk recorded no further conditions on the variance during the meeting.
The Board did not elaborate on any administrative next steps during the session; Acting Chairman Bender asked clerks Terri O'Keefe and Lisa Lincoln to follow up by email on outstanding questions about maintenance and other details. The Board adjourned at 7:05 p.m.
