The resolution directs the Harvey County Planning and Zoning Department and the Planning Commission to review the county’s Comprehensive Plan and Unified Development Code for regulations specific to commercial B.E.S.S. projects and to suspend action on Conditional Use Permit applications and construction for commercial projects while that review proceeds. The resolution states, in part, “The establishment of any Commercial Battery Energy Storage System (B.E.S.S.) … in the unincorporated area of Harvey County is hereby suspended and prohibited,” and is set to remain in effect until Jan. 1, 2028 unless the board adopts regulations sooner or extends the moratorium.
Commissioner Don Schroeder noted staff and legal counsel recommended edits to the draft before signing. The resolution exempts private, noncommercial systems intended for individual property-owner use. The action at this meeting was to sign the revised resolution; the minutes record that the resolution had been voted on at the July 8 meeting and was not rescinded.
The Planning and Zoning Department is directed to prepare text amendments and comprehensive-plan updates as needed; the timeline for that work was not specified in the minutes.
