The Tell City Common Council adopted Ordinance No. 12-40 on Aug. 3, creating a regulatory framework for demolition work within the city’s zoning jurisdiction.
The ordinance requires a demolition permit for most structures (exempting minor detached accessory structures under 150 square feet), sets application prerequisites (proof of ownership or authorization, utility disconnects, asbestos/environmental steps for commercial work), and requires a site safety and restoration plan. The ordinance sets nonrefundable permit fees (a $35 fee for residential structures and $100 for commercial structures), insurance or performance-bonding requirements prior to permit issuance, and operating restrictions including permitted hours (7 a.m. to 7 p.m.) and dust/debris controls. A building inspector may issue stop-work orders and levy civil fines of not less than $100 and not more than $2,500 per violation.
“There will be a a nonrefundable permit fee of $35 for residential structures and a $100 for commercial structures,” counsel summarized in the meeting reading. Council suspended the rules for second and third reading and adopted the ordinance by voice vote; it becomes effective upon passage and any required publication.
The ordinance aims to standardize demolition work, reduce public-safety and environmental risks, and provide the city enforcement tools if demolitions are not completed properly.
