Utilities board adopts new pole-attachment agreement to align with tariff and add enforcement remedies

Utility staff presented a new pole-attachment agreement to bring the city's practices into alignment with its tariff and clarify the application and enforcement process for communications providers who attach equipment to utility poles.
"So this was drafted new to be in line with the tariff, clarify the application process and the requirements," the director said, describing added application fees, renewed terms and stronger language for emergency safety responses that could be billed to the communication company if issues are not addressed. Board members asked whether the agreement includes time frames to remove old attachments from replaced poles; staff confirmed the agreement contains enforcement language and the board approved the agreement.
The new agreement does not supersede existing contracts with some providers (staff named current contracted providers) but applies to other communications companies that lacked formal agreements.
