Klamath County SD board receives Title IX appeals training; counsel warns of confidentiality and recommends legal presence

Klamath County School District directors received a Title IX appeals training from district counsel during a special board meeting on Sept. 19, 2024. Attorney Rebekah Jacobson explained the Oregon Department of Education requirement that school boards be trained to hear Title IX appeals and that the board members had received her presentation via Boardbook.
Jacobson told the board that "a Title IX investigation is much more technical than a standard investigation," and that the confidential nature of some complaints can mean "the hearing and decision may be held in executive session." She said the training materials were attached to the meeting agenda in Boardbook and recommended that the school board have legal counsel present during any Title IX appeals process.
Jacobson advised the board that, because of confidentiality rules tied to Title IX complaints, board-level consideration is one of the rare situations in which a school board may make a decision in executive session. She characterized the appeals process as legally sensitive and suggested counsel be available to advise the board through investigations and hearings.
The special meeting was called to order at 4:01 PM by Steve Lowell and adjourned at 4:48 PM. Attendees listed in the meeting minutes included board members Brooke Kliewer, Jill O'Donnell, John Rademacher, Superintendent Glen Szymoniak, Director of Human Resources Jamie Ongman, Executive Assistant Stephanie Bland, and attorney Rebekah Jacobson (who joined via Zoom). Marc Staunton is recorded as arriving at 4:34 PM. No formal votes or motions were recorded in the minutes for this meeting.
