The Village Board considered whether to add production-guarantee language to the RecPlex solar installation contract and voted not to adopt the proposed clause.
A presenter summarized the proposal: "Art Solar guarantees that the system will produce at least 1,047,173 kilowatts annually which is 90% of the expected output of the system for a period of 10 years," with production monitored via SolarEdge and a compensation rate of $0.045 per kilowatt hour for shortfalls; excess generation above 105% would be shared 50/50. Staff also described a 12-month opt-out provision. Trustees and staff discussed the economics and risk allocation for the village, including that the guaranteed numbers were based on a static utility rate of 9.5¢/kWh in the staff analysis.
Several trustees and advisors questioned the premium and asymmetric exposure. Administrator Eric said bluntly in the discussion that in a long run comparison "House wins," urging caution about whether the village was paying a premium for the guarantee. After discussion a motion "not to accept it" was made and carried; the guarantee language will not be added to the contract and staff indicated they will call a special meeting to address the overall solar contract in the next week or two.
