Chairman Vaughn presented House Bill 23 85 and an amendment to clarify that property owners may request connection to a gravity sewer line if the line is on the owner’s property or immediately adjacent within public-rights-of-way, access easements or public utility easements. The sponsor said court decisions prompted the clarification and the amendment (drafting code 13 230) was adopted.

The sponsor told the committee the clarification resolves ambiguity about when a property owner may request service and is intended to prevent strict judicial interpretations from limiting connections.
