Treasurer says platform could enable real-time gold transactions but notes tax hurdles

State Treasurer Marlo Oakes told the House Business and Labor and Commerce Committee that HB306 contemplates an electronic transactional platform to enable dollar-to-gold conversions and in-state storage at institutions meeting Utah safety standards. "The platform could facilitate real time transactions, dollar conversions, and secure gold storage in Utah under strict state safety standards," Oakes said.
Oakes also flagged a structural obstacle for widespread transactional use of gold: current IRS policy treats gold and silver as capital assets and collectibles, subjecting gains to capital gains tax. "If an individual experiences an increase in the value of their gold holdings and then chooses to transact using that gold, they are currently subject capital gains tax on the appreciated value," Oakes said, noting that frequent transactions could create repeated taxable events. Her presentation underlined that the committee's bill focuses first on creating vendor option and platform mechanics; advocates seeking broader change would need federal tax-policy adjustments to make frequent gold transactions practical.
