The Old Tappan Mayor and Council on second and final reading adopted Ordinance 12 48-24, a revision of the borough's tree preservation and removal code. Councilman Boyse introduced the ordinance and opened the matter for a public hearing before the council recorded its approval.
Council members said the ordinance is the product of extended review by the planning board, environmental commission and the construction official. The borough attorney flagged two minor, non-substantive edits: a numeric inconsistency in section 2-34-9(a)(2) (the correct figure is "2") and insertion of the phrase "or his or her designee" after "construction official" in section 2-34-12(b). The attorney described both as scrivener's errors that do not require reintroduction.
"This is 2nd reading for final adoption," Councilman Boyse stated when presenting the ordinance. The council then moved to adopt the measure on second and final reading and recorded affirmative votes.
The ordinance replaces sections 2-34-8 through 2-34-18 of the borough code and directs the clerk's office to publish the notice of adoption as required by law. The council indicated the planning board and environmental commission reviewed the draft and recommended the changes. The adoption takes effect according to the publication requirements set forth in the ordinance.
Council members said they will correct the two scrivener errors in the adopted text prior to publication.
