Lake Como council endorses updated housing element to secure developer immunity

The Lake Como Borough Council unanimously endorsed an updated Housing Element and Fair Share Plan at its June 17 meeting after a presentation from borough engineering and planning consultants.
Borough Engineer Sam Avakian told the council, "this is the 4th round of affordable housing and to avoid builder’s remedy, the Borough must endorse this plan by June 30th." Planner Christine Bell warned of the consequences of inaction, saying, "without this plan in place, builders and developers can come in and regardless of zoning regulations, put affordable housing anywhere." Mayor Higgins and all councilmembers voted to endorse the draft attached to the minutes.
The endorsement, the council was told, grants immunity beginning July 2025 and extending through 2035. Councilman DeMauro moved to endorse the plan and Councilman Witte seconded; the motion carried on a roll-call vote with all six councilmembers recorded as yes. The draft plan is part of the meeting record and was discussed at the Planning Board the night before, where officials raised multiple questions that were addressed at the council meeting.
