Board split over data-center moratorium as directors debate legal risk and land-use authority

Board debate on the moratorium revealed a sharp split over legal defensibility and policy approach. "This is temporary. It is legal. It is a sound pause," Webb said.
Director Hines opposed the measure, noting that the port area was created to accommodate industrial uses and warning that a moratorium could lead to costly litigation. Hines said, "I am not an attorney... but I am gonna oppose this moratorium and I'll call the question," arguing that similar industries with heavier impacts had been allowed in that planning area.
Vice Mayor Weierich stated he would support the moratorium to give the city breathing room to evaluate development impacts and review police powers and emergency preparedness; he asked for additional questions to be answered by Google if the pause is adopted. The clerk then called a roll call; the board recorded four yes votes and four no votes and the measure failed for lack of six affirmative votes in the 10-member body.
