During public testimony Heather Black asked whether the town’s denial would stop the project or if the applicant could take the matter to De Kalb County. Zoning Administrator Brandy Williams said the town could prepare materials for the county and explained that, depending on location and state law, county approval is possible: "the answer could be, yes, within 1-1/2 miles of the Cortland corporate limits."
Attorney Richard Porter also addressed legal exposure, telling the commission that if a project meets county regulations a town denial could be vulnerable to legal challenge. The exchange clarified that county review is a potential path if the applicant chooses to pursue it after local action.
