DMS reports 70 involuntary terminations in past year; plans system changes and external review

Elizabeth Markle, waiver branch manager with DDID, reported the agency had recorded 70 involuntary terminations in the last year, 53 of which were residential‑service cases. "As of 07/31/2026, the total number of involuntary terminations in the last year is 70," Markle said. She also provided shorter‑term counts: 46 terminations in the last six months (36 residential) and eight in the last month (seven residential).
Carmen Hancock described planned process improvements: updates to the MWMA involuntary‑termination screens (additional fields and checkboxes to capture reasons and prior efforts), expanding critical‑incident data collection, a stand‑alone grievances and appeals regulation, and an external review option for certain termination types — for example, using human‑rights committees for independent review. DMS emphasized the work is collaborative across cabinet agencies and will take time to implement.
Committee members raised questions about frequency of unannounced visits, how quickly transfers occur, and whether participants moved to other providers continue receiving services — Markle said terminated individuals are still receiving services from the provider of record while transitions are worked through. DMS said it will provide more detailed data and examples in follow‑up materials.
