Public commenter warns planning commission: stormwater and subdivisions have limited local jurisdiction

Tom Markovich, introduced to the meeting as a member of the public, told the commission he had reviewed the workshop materials and urged caution about the scope of local regulation on stormwater, schools and utilities. “Stormwater is a pollutant, period,” Markovich said at the podium, expanding that the National Pollutant Discharge Elimination System (NPDES) and state actors govern much of the field.
Staff and commissioners engaged Markovich on specifics and agreed that many permitting triggers — including septic-permit processing and DOT encroachment permits — are driven by state agencies. Staff said the county’s authority is limited in some areas and reiterated that changes to requirements like traffic-study triggers or septic demands may need coordination with state agencies and legal review.
