Milbank council forms Capital Improvement Board to pursue voter-approved CAPS projects

Administrator Steve Pendergrass summarized the new CAPS authority under Senate Bill 1245, explaining the program "allows municipalities to implement an additional sales tax of up to 1% to fund capital improvement projects for a period of up to five years" and requires approval by at least 60% of voters. Pendergrass described statutory requirements including the formation of a five-member Capital Improvement Board (CIB), project-use restrictions for generated funds, and a requirement that funds not be expended until a project funding goal is achieved.
Council members discussed potential projects such as daycare facilities, community trail expansion and completion of Lake Farley improvements, noting the need to define project scope, costs and timelines and to ensure community engagement and transparency. The council approved Resolution No. 5-11-26 establishing the CIB (motion carried 6-0), authorizing the mayor to appoint five members (one must be a council member) to review and prioritize CAPS-eligible projects and to approve the ordinance before any ballot placement.
Pendergrass and the council emphasized that any tax measure would require voter approval of at least 60% at a regularly scheduled election and that a two-year waiting period is required before a new application after the five-year period ends.
