Court of Appeals reverses and remands in two cases affecting Chattahoochee County
Summary

County Attorney Bin Minter told the Commission that the Court of Appeals issued two opinions that affect pending litigation involving the county.
Minter said the Court of Appeals reversed the Superior Court in UGOCCC v. Damon Hoyte, reinstating the magistrate court's earlier decision that had upheld a zoning-ordinance conviction and the county's prior fine collection. "The Court of Appeals reversed the decision and reinstated the original decision and prior rulings of the magistrate court," Minter reported to the board.
Separately, Minter summarized Melissa Haymond v. Hoyte, in which the county is a co-defendant. He said the Court of Appeals reversed the Superior Court's denial of Haymond's motion to dismiss and remanded the case to Superior Court; motions to dismiss remain pending. The attorney emphasized these are procedural developments and that any next steps will proceed through the Superior Court docket.
The legal update was provided during the Oct. 7 meeting; no formal vote was required. Commissioners did not indicate further immediate action beyond monitoring the cases and awaiting additional filings.
