Council criticizes ARB memo for overstating authority; DRB role clarified

Council members flagged a memo circulated by the developer's Architectural Review Board (ARB) as inaccurate and overreaching. The mayor said the memo incorrectly claimed the ARB could impose fines and stop-work orders and mis-cited state statutes. He said the ARB's review authority covers aesthetics of buildings, fences and structures under private covenants but not enforcement of town ordinances or contractor conduct. "The memo ... was really kind of stunning in its inaccuracy and its overreach," the mayor said.
Council discussed the town's Design Review Board (DRB), created last October to provide a public review process for larger commercial and multifamily projects that the developer ARB had historically overseen. Council members agreed it's premature to change the DRB's scope or to transfer authority until the omnibus agreement between KICA and the developer is finalized and the DRB has demonstrated operating procedures and transparency. One council member warned that reversing the DRB prematurely could "waste the effort we've had in building that backstop."
The mayor said the town will seek corrective communications and, if the ARB does not correct the record, the town will issue its own clarification to contractors and property owners explaining the limits of ARB authority and the separate roles of the town DRB and the developer ARB.
