The Riley County Commission approved a temporary right-of-entry and access agreement to allow staff and contractors to access the Deep Creek Sewer Benefit District lagoon for necessary maintenance while a permanent easement is completed.
Jacob Hance, who presented the item, told the board the agreement was intended to avoid litigation and provide immediate access: "The agreement itself, concerns access to the Deep Creek Serve benefit District Lagoon," he said, explaining the parties had been agreeable to negotiate a temporary arrangement rather than pursue eminent domain. A commissioner moved the measure, it was seconded and the board voted to approve the temporary access agreement; the chair signed the approval.
Staff said the agreement was a short-term mechanism to keep the sewer system functioning while a permanent easement description is developed. No additional funding or amendments were discussed at the time of the vote.
