"The topic or purpose of this executive session is for the board to receive attorney consultation and for the board to provide direction on potential negotiations with claims," the Chair said. A board member moved "to discuss the Wilkinson Elementary potential settlement, in executive session," the motion was seconded and the Clerk recorded 'Aye' votes; the Chair announced the motion carried.
The Chair cited the legal authority to close the session as North Dakota Century Code section 44-04-19.1, subdivisions 2, 5 and 9, and reminded members that any legal or final action must occur in open meeting unless law permits otherwise. The Chair also said the executive session would be recorded and asked the members of the public attending the meeting to leave the room. The board anticipated reconvening the open portion of the meeting at approximately 12:25 and directed that minutes reflect the executive session begin time.
