Abby Baker, director of Grand County Public Health, told the Board of Health that a retail food establishment denied inspection attempts on Jan. 28 and Jan. 29 and did not complete its 2026 license renewal after receiving mailed renewal notices. Baker cited Colorado statute CRS 25-4-1610 and said the department issued two notices of violation (in person on Jan. 29 and again on Feb. 20, both sent by certified mail and received), and the operator did not contact the department by the one-week deadline.
Baker recommended filing for an injunction to stop the operator from continuing to serve food without a valid license and noted civil-penalty authority of $250–$1,000 per violation. Commissioners directed staff to proceed with injunctive action and discussed assessing the maximum statutory penalty of $1,000 per violation (two violations cited would total $2,000), while reiterating the department’s preference to work with businesses to achieve compliance where possible.
