ZBA upholds stop-work order for Neck Path property, denies appeal

The board considered an appeal by 114 Neck Path LLC of a stop-work order issued under the East Hampton Town Code. Member Berger summarized testimony from Russell Young, director of enforcement, and photos showing excavation and work on the pool that went beyond a simple liner replacement. "When the enforcement people went out, they saw that the pool was also being dug out... they were also putting in a patio around the pool, and they were putting in an outdoor kitchen," Member Berger said.
Board members agreed the recorded work had exceeded permitted scope and required approvals. Multiple members said the evidence supported upholding the stop-work order and denying the appeal; the board affirmed the enforcement decision and directed follow-up through the building department.
