County amends FOIL policy: unpaid copying fees cause request to be deemed abandoned after 30 days

County Attorney Dan Martindale read proposed wording to amend Section 5 of the county's FOIL policy: once the requestor has been notified that copying and production fees are due and owing, if payment is not remitted within 30 days of notification the FOIL request will be deemed abandoned and a new request must be submitted. The proposed amendment also included language that, once payment is remitted, copies will be provided within seven business days.
Committee members discussed the intent and the County Administrator emphasized the change was not intended to deter FOIL access but to clear longstanding unpaid fee requests. The committee adopted the amendment; minutes record the motion was moved by Mr. Wang, seconded by Messrs. Herrick and O’Brien, and adopted.
