Easement and MDOT approvals remain outstanding for Chick-fil-A access connection
Summary
Commissioners were updated that the Chick-fil-A site still awaits MDOT approval for a storm-drain tie-in and for the access connection/change-in-use; property owners and Chick-fil-A are negotiating easement details and the project remains contingent on MDOT sign-offs.

During the planner's report commissioners raised the status of the Chick-fil-A project and associated easements. Troy said two items remain outstanding: MDOT approval for the storm-drain tie-in and MDOT approval for the access change-in-use associated with the connection to the adjacent road. He also noted there is a parcel between Heartland Road and the Chick-fil-A property that is not Chick-fil-A's property and that the owners of the remainder of the development are working with Chick-fil-A on that connection and easement.
When asked whether the planning commission was waiting on items, Troy said the planning commission itself was not waiting, but the site is waiting on MDOT approvals related to drainage and access. "They are waiting for MDOT to approve that," Troy said, noting the storm drainage and the access-change approvals are the remaining external approvals. The update leaves the Chick-fil-A project dependent on a state-agency (MDOT) sign-off for stormwater and access changes before it advances to final local approvals.
What to watch: Any future meeting packets or staff memos that note MDOT approvals or updated easement agreements between Chick-fil-A and adjacent parcel owners will be the next indicators that the project can proceed to final local permitting.
