APC reviews draft fee schedule to comply with new Indiana law effective Jan. 1, 2027

Todd, the area plan director, presented a reworked appendix A and ordinance text to bring the county into compliance with Indiana Code IC 36‑7‑2.3, which changes how counties must calculate and account for planning and permitting fees beginning Jan. 1, 2027. He said the proposed schedule was developed from the office’s actual budget, staffing costs, and workload data and uses a mix of base fees plus per‑square‑foot charges for many building permits.
Todd said the schedule accounts for fully loaded salaries, an estimated 15,000 miles of annual inspector travel (about 5.5 miles per inspection), and the office’s permit/inspection workload. He told commissioners the state board of accounts requires covered revenues to be deposited in a dedicated county fund and that counties must demonstrate fees are reasonably related to costs. “The general assembly adopted IC 36 7 2.3, which is the new Indiana law, which changes how counties must calculate, collect, account for, and use certain planning, zoning, building, development fees beginning 01/01/2027,” he read to the body. The commission was asked to divide review assignments and return edits to staff before an anticipated public hearing in the fall.
