Board affirms earlier authority to release Poe Acre open-space covenants for water infrastructure

County Attorney John Norris briefed commissioners on a request tied to Poe Acre in Chesapeake Ranch Estates and asked the board to reaffirm its 2021 authority allowing the release of certain irrevocable open-space covenants.
Norris explained that the property owners association had placed irrevocable covenants on roughly 600 lots to receive a property-tax credit; Chesapeake Water Company identified four lots where water infrastructure is needed to serve about 60 residents as a backup to an existing well. Norris told the board the release submitted this year included three of the four parcels and did not include the reserve parcel.
"The request is for the board to affirm the 2021 grant of authority for the president to sign the release of open space irrevocable covenants," Norris said. Commissioners moved and seconded that affirmation and approved the motion by voice vote.
Norris also noted there are other covenants and restrictions on the property not addressed in this particular request and that the county is not changing those here.
