JLARC staff presented a review of a real-estate excise tax exemption intended to facilitate transfers of homes to qualified nonprofits that provide supported living for adults with developmental disabilities. Staff reported the preference has not been used and recommended allowing it to expire because it has not increased housing availability as intended.
Staff and stakeholders suggested several reasons for nonuse, including a small number of qualifying nonprofits and narrow statutory conditions for qualifying transfers. A DSHS report cited by staff noted approximately 16,000 adult DSHS clients live with family and that about 20% have guardians aged 65 or older—creating a potential future need for housing options if guardians can no longer provide care. Staff suggested that if the legislature prioritizes housing for this population, it should work with DSHS to identify alternative strategies to achieve that goal.
