Commission recommends Lloyd property application be withdrawn for lack of public notice

Staff and commissioners agreed Aug. 3 that the Lloyd property applicant amended their request after the public hearing and that the amended proposal lacked required public notice; the commission recommended treating the application as withdrawn so the applicant can restart the process.
When planning staff reported that a Lloyd property applicant had amended a land-use request two days after a public hearing closed, the commission concluded the amended request had not been subject to public notice and recommended withdrawal so the applicant could pursue proper notice and hearings.
Jessica Andritz told commissioners the Lloyd owner had asked to expand the Lexington Park Development District and to change land use to medium-density or mixed-use, but that change arrived after the public hearing. Staff outlined three options: treat the application as withdrawn, split the application to vote only on the boundary expansion, or act on the amended request without a hearing. Commissioners favored withdrawal so the community and agencies could see and comment on the revised proposal. A motion reflecting that recommendation was adopted.
