Council adopts ordinance to implement state-mandated administrative review for certain development applications
Summary
Ordinance No. 1251 amends Chapter 11 of the Town Code to provide administrative approval procedures for certain development applications to comply with A.R.S. § 9-500.49 (House Bill 2447). Council approved the ordinance 4–1.
Community Development Director Steve Boyle told the Council that the Arizona Legislature enacted House Bill 2447 and its provisions (codified in A.R.S. § 9-500.49) require municipalities to offer administrative approvals for specific development applications that meet objective standards. The proposed Ordinance No. 1251 amends Chapter 11—Subdivision to establish administrative review of site plans, plats, lot-line adjustments, and similar actions where objective standards are satisfied.
Director Boyle and Town Attorney Trish Stuhan explained the town’s discretion is constrained by the state law; failure to comply could result in penalties or loss of funding. The ordinance passed by a 4–1 vote (No: Councilmember Art Rubash).
