County to withhold $133,000 after asphalt mix failed to match paving design

Jud, the project engineer, told the Grand County Airport board that trucks delivered asphalt that "was not what was designed" and staff refused to accept the material. Jud said the contractor combined two planned paving lifts into a single day, producing a mix that sat at the low end of acceptable performance and triggered a pay adjustment. "We're deducting a $133,000 of payment to TSJ," Jud said, and staff indicated that deduction will flow through the prime contractor and to the grant payment process.
Board members also heard that Legrand (the prime) and its subcontractor experienced payment and plant problems that delayed the schedule. Staff said the job is currently about 11 days over the 45-day contract schedule and that the county will assess liquidated damages consistent with contract terms. Jud outlined the plan to resume paving the first lift the next morning, compact and test that lift as a standalone production lot, then place the second lift the following day with an aim to reopen portions of pavement by Thursday or Friday.
