Attorney Wyatt D. Swinford of Swinford, Elias, Books, Brown & Nelson, P.C., addressed the board on behalf of The Icon and said there is uncertainty about the legal interpretation and implications of the courts decision. The board concluded it needed a legal opinion before reaching a determination and agreed to postpone action. "Following a discussion with Mr. Wyatt Swinford about the value determined by the Supreme Court ruling, there is uncertainty about the legal interpretation and implications of the court's decision," the minutes record.
Member John Wullich moved to table the item to July 23, 2025; Chairman Chuck Thompson seconded and both voted yes. The board recorded no further public comment on the item during the meeting.
