The Village of Bensenville Board of Trustees on Feb. 18 approved an ordinance authorizing a reimbursement agreement that lets several property owners pay for public improvements to Arthur Court, up to a cap of $950,000. The vote was recorded with four yes votes; two trustees were absent.
A staff member identified as Joe told the board the road is in a business district and "the infrastructure has come to the end of its useful life. It requires immediate and substantial repairs." He said property owners approached the village offering to fully fund the work instead of participating in a proposed special service area (SSA), and the board acted to permit that arrangement before a scheduled public hearing so owners could deposit funds and potentially be removed from the SSA.
Under the agreement described to the board, the owners would pay for design, construction and construction engineering for the project up to $950,000; if actual costs exceed that amount, the village would cover the overage. Owners have five days to deposit the funds identified in the agreement. Staff also told trustees that if any funds remain in the account at year-end, the village would pay interest back to the property owners on the remaining balance.
Officials said plans and specifications are complete, the project was scheduled to be put out to bid later in the week, and contracts would come back to the board in March with a likely construction window of April through July. "We're here tonight because or today because we needed to get this agreement approved prior to our public hearing next Tuesday and provide them enough time to deposit their funds," the staff member said.
The clerk conducted a roll call for the ordinance vote. Trustees Frans, Frey, Lomax and Panacola voted yes; Trustees Carmona and Perez were absent. The presiding official announced, "Motion carries and ordinance has passed." The board heard no public comment at the meeting and had no additional business before adjourning.
Next steps identified by staff include returning to the board with contracts in March and proceeding with the advertised bid process this week.
