Council delays new data-center moratorium, awaits Planning Commission definitions

Council members discussed the prospect of a moratorium on data center development and whether the city should adopt an ordinance or wait for planning staff to produce definitions. One council member said the planning commission has been asked to study and define 'data center' because current regulations only reference telecommunications hotels and do not cover modern data-center facilities.
"Right now, the regulations do not contain any regulations for a data center," said a staff member (speaker 9), describing the gap and the Planning Commission's ongoing work. Staff and council members cautioned that a short, 60-day moratorium under KRS could backfire: if the council refuses to act within that window, a Planning Commission recommendation can become effective by operation of law. Given that risk, the council agreed to wait for the Planning Commission's draft definitions and recommendations before drafting a moratorium or ordinance.
