Chair Jay Leach explained the disparity in sanctions on the record, saying he expected more responsiveness from someone in judicial office: "I would expect a superior court commissioner, a sitting superior court commissioner to at least respond to information from a public agency about his compliance with the law." The chair said that expectation informed the decision to impose a larger unsuspended penalty in Middleton's case and directed staff to reflect the requirement to file the missing F‑1s in the written orders.
