PDC takes judicial notice after staff failed to notify complainants; prior enforcement orders re-entered

Jordan Campbell, presenting for staff, explained the procedural error: "The staff failed to provide notice of the hearings to their complainants, both of them." Chair Leach said he would take judicial notice of the testimony presented on June 11 and re-enter the prior orders, adding that he would impose the same penalties as in the earlier adjudications. The commission did not take additional testimony in these matters and directed staff to prepare the written orders reflecting the re-entered findings and penalties.
The matter was procedural in nature: the commission addressed a staff notice failure, confirmed the original findings, and restored the prior sanctions rather than rehearing the evidence. Commission staff will issue written orders with the imposed penalties and deadlines for any payments or compliance steps.
