DuPage County board asks petitioner for legal citations; hearing record remains open

The DuPage County Zoning Board asked the petitioner in the Lucky Penny case to provide the statutory citations and authorities referenced in the presentation and to submit those materials to staff.
Chair asked counsel to "supplement the record a little bit by sending us just a swivel of that" and directed the petitioner to communicate the authorities to staff; counsel agreed to do so. The record shows one formal objection filed by the City of Wheaton and that several county departments reported no conflicts on file.
No final vote or recommendation was issued at the July 15 hearing. The chair closed the hearing and noted the matter will be on the agenda for a recommendation hearing on Sept. 10 at 5:30 p.m. in the same room.
