Council restores city code on vehicle registration for parked cars, amends wording from 'driver' to 'owner'

The council adopted Ordinance No. 26-24 to add a section to the Beatrice City Code regarding registration requirements for parked vehicles, restoring a provision removed during a prior recodification. Staff said the police department requested reinstating a registration violation for parked vehicles, which previously existed in local code before codification changes and the matter being handled under state statute.

During the ordinance discussion a council member proposed fixing a typo in subsection C. City staff explained subsection C incorrectly read that "driver" was prima facie evidence and that it should say "owner." Taylor (city staff/legal) explained that owner is the correct legal standard for prosecution. A motion to amend subsection C from "driver" to "owner" was moved, seconded and passed 7–0. The council then proceeded with votes required by suspended rules and ultimately adopted the ordinance; councilors discussed the possibility of reviewing related language in section A to ensure enforcement targets owners rather than the last person who parked a vehicle.

Council members and attorneys discussed whether to leave other language unchanged or to seek judicial guidance; staff agreed to review and, if necessary, bring further edits back to council. The ordinance passage and the amendment were recorded in the meeting minutes and approved by unanimous vote.
