Chairman Dan Polhamus explained the ordinance addresses a gap in the town's existing enforcement framework and that state law requires the hearing officer(s) be appointed by the chief executive officer. The town manager also noted the proposed ordinance affects roughly fifteen existing ordinances that include enforcement mechanisms.
Council members discussed the interplay between uncontested payment provisions and hearing notice procedures; the Assistant Town Manager explained that an alleged violator who pays a citation does not admit liability and that separate notice steps apply if the fine is unpaid and a hearing is requested. Council also requested correction of a typographical cross‑reference in the draft ordinance.
The council approved adoption unanimously (motion by Mrs. Brathel, seconded by Ms. Ausiello). The ordinance establishes procedures for citation issuance, hearings, assessments, defaults and appeals; the town manager will implement administrative processes identified in the ordinance.
