Board hears update on Elite charter school's protest of state audit and waits for certified notice

Courtney, representing SCOE fiscal and business operations, told trustees that Elite's attorney has replied to SCOE questions but that Elite has not yet received the state controller's certified letter required to file an appeal with the Education Audit Appeals Panel. "They've confirmed with the EAAP that as soon as they receive the letter via certified mail, they can file the appeal within the timelines," Courtney said.
Courtney explained that the state controller reported an attempted certified delivery on Nov. 12 that was not reattempted, while SCOE staff had already received a courtesy copy. The EAAP indicated there is no statutory deadline for its determination and that appeal resolution can take "between 3 and 6 months once the appeal is submitted," Courtney said. Trustees asked for clarification about whether Elite's performance-category status should be moved before 2025 scores are finalized; the board discussed delaying status changes until the state designation is clear.
Jess Deans Wright also updated trustees on Elite's internal improvements, including a teacher residency program (partnering with Touro University) and growth of middle-school athletics; board members acknowledged progress but emphasized due process around appeal timelines and final performance designations.
The board did not take an enforcement action at the meeting; staff said they will revisit timelines after Elite files the certified appeal.
